NO PURCHASE OR ACCOUNT NECESSARY TO ENTER OR WIN THIS PRIZE DRAWING, OR TO CLAIM A PRIZE. A PURCHASE OR ACCOUNT WILL NOT INCREASE YOUR CHANCES OF WINNING.

Cape Cod 5’s Swipe into Savings Holiday Sweepstakes (the “Sweepstakes”) program begins at 8:30 a.m. EST on Monday, November 4, 2024 (the “Sweepstakes Start Date”) and ends at 11:59 p.m. EST on Sunday, December 15, 2024 (the “Sweepstakes End Date”), (such period referred to herein as the “Sweepstakes Period”). The Sweepstakes is sponsored by The Cape Cod Five Cents Savings Bank (the “Sponsor” or “Cape Cod 5”).

1. HOW TO ENTER: There are two ways to enter the Sweepstakes during the Sweepstakes Period. 
     i. Automatic Entry Method. During the Sweepstakes Period, eligible entrants who use their Cape Cod 5 Visa® debit card (“Eligible Card”) connected to a Cape Cod 5 personal checking account (the “Eligible Account”) during each week of the Sweepstakes Period, with each transaction posted to the Eligible Account with a purchase date (the “Purchase”) during the Sweepstakes Period, will receive one automatic entry per Purchase in the Weekly Drawings (as later defined) for each Purchase completed during that week. There is no maximum number of entries for the Weekly Drawings. In addition, you will also receive one automatic entry per Purchase in the Grand Prize Drawing. There is no maximum number of entries for the Grand Prize Drawing. 
     ii. Mail-In Alternative Entry Method. During the Sweepstakes Period, eligible entrants may hand print the eligible entrant’s name, address, city, state, ZIP Code, telephone number, e-mail address and date of birth on a 3” x 5” card and mail the card in a hand-addressed, stamped envelope to Swipe into Savings Holiday Sweepstakes, Cape Cod 5, 1500 Iyannough Road, Hyannis, MA, 02601. Mailed entries must be received by the “Mail-in Received By Date” listed in the chart (refer to section 4. SELECTION OF WINNERS) to be eligible for the corresponding Drawings. Limit 1 entry per envelope. Mechanically reproduced, photocopied, illegible, incomplete, or inaccurate entries are automatically void. Mail-in entries will NOT be accepted via messenger/courier delivery service or any means other than United States Postal Service mail. Entrant is solely responsible for properly sending the entry and all related costs. Mail-In Entries for the Grand Prize Drawing need to be specifically marked “For Grand Prize Drawing.”
 

2. PRIZES: There will be a total of six (6) prizes available in the Sweepstakes. The maximum aggregate value of all prizes awarded for the Sweepstakes will be $5,000.00. 
     i. Weekly Drawings: The Sponsor will conduct a total of six (6) random weekly drawings (each, a “Drawing” and collectively with the Grand Prize Drawing, “Drawings”) on or about the days set forth among all eligible entries timely received during the periods set forth on the table below (see section 4. SELECTION OF WINNERS). Please note that automatic entries will be deemed received on the date the Purchase occurs to be eligible. Entries for each Weekly Drawing will not be included in subsequent Weekly Drawings. Odds of winning will depend on the number of eligible entries timely received. Each Mail-In Entry for the Weekly Prize Drawings specifically marked “For Weekly Prize Drawing” and received by the “Mail-in Received by Date,” will receive one (1) entry for the Weekly Prize Drawing. At each Weekly Drawing, (each, a “Weekly Drawing”) the Sponsor will randomly select one (1) entry from all eligible entries received during the applicable time period for a $500 prize in the form of a Cape Cod 5 Bank issued check or funds will be deposited directly into the winner’s Cape Cod 5 account of their choosing.
     ii. Grand Prize Drawing: Eligible entrants will receive one (1) automatic entry to the Grand Prize Drawing for each settled Purchase transaction during the Promotional Period. Each Mail-In Entry for the Grand Prize Drawing specifically marked “For Grand Prize Drawing” and received by the “Mail-in Received by Date,” will receive one (1) entry for the Grand Prize Drawing. The Grand Prize Drawing will be held on December 18, 2024. Odds of winning will depend on the number of eligible entries timely received. At the Grand Prize Drawing, the Sponsor will randomly select one (1) entry from all eligible entries for the Grand Prize Drawing for a $2,500 prize in the form of a Cape Cod 5 Bank issued check or funds will be deposited directly into the winner’s Cape Cod 5 account of their choosing. There will be one (1) prize awarded per winner. Each winner will be solely responsible for all other expenses not specifically set forth herein. The Sponsor reserves the right to substitute prizes of equal or greater value. No other substitution or transfer of prizes permitted. The Sponsor is responsible only for prize delivery; not responsible for prize utility, quality or otherwise. In order to receive a prize, winner(s) will be required to provide proof of identification. Taxes on any prize, including income and/or sales taxes, are the sole responsibility of winner(s). The winner(s) of a prize with a value of $600 or greater will be issued a 1099 U.S. Tax Form for the retail value of the prize.

3. ELIGIBILITY: Sweepstakes is only open to any customer of Sponsor or non-customer who is a legal resident of the Commonwealth of Massachusetts and at least 18 years old at the time of entry. Entrants must possess a valid I.D. or other means of I.D. acceptable to the Sponsor. Entries are limited to individuals only; commercial enterprises, groups, clubs, businesses, trusts or other organizations are not eligible. By participating in the Sweepstakes, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the Sponsor and warrants that s/he/they is eligible to participate in the Sweepstakes. Employees, independent contractors, officers, and directors of the Sponsor, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, and their immediate family members and persons living in the same household, are not eligible to participate in the Sweepstakes. SWEEPSTAKES IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW and is subject to applicable federal, state and local laws and regulations. For automatic entries, only eligible entrants making Purchases with an Eligible Card that is not in default under the customer agreement for the Eligible Account, both at the time of purchase and at the time of the applicable Drawing (as defined below), are eligible for automatic entry. No entry will be granted to any entrant whose Eligible Account is overdrawn or has been closed at the time of the Drawing. All automatic entries will be deemed to be submitted by the primary person in whose name the Eligible Card used to enter the Sweepstakes was issued. Account adjustment transactions, foreign transactions, returns, cash advances, ATM transactions or similar cash withdrawals, balance transfers, and payment of late fees or over-limit fees to the Sponsor or any affiliate of the Sponsor, are excluded from automatic entry. Eligible cards or card numbers that are stolen, fraudulent, tampered with, or otherwise altered are not eligible for participation in the Sweepstakes.

4. SELECTION OF WINNERS: The decisions of the Sponsor are final and binding in all matters relating to the Sweepstakes, including the Drawings. The eligible entrants selected (subject to verification of eligibility, the “Winners”) will be notified by phone, e-mail and/or U.S. Mail on or about two (2) business days following each Drawing. A Winner in one week can receive additional entries for the Grand Prize Drawing but cannot be a Winner in an additional Weekly Drawing. Winners must meet all eligibility requirements. The Sponsor is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify winner(s). Winner(s) agrees to use of name, address, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law. Where lawful, winner(s) may be required to sign and return a Publicity Consent and Liability Release.

 

5. CONDITIONS: The Sponsor and its agents, directors, officers, shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, advertising, promotion, and fulfillment agencies, legal advisors, Meta Platforms, Inc., (the “Released Entities”), are not responsible for, shall not be liable for, and hereby disclaim all liability arising from or relating to: (i) late, lost, stolen, delayed, damaged, misdirected, misaddressed, incomplete, unintelligible or postage-due entries; (ii) telephone, electronic, hardware or software program, network, Internet, computer or other malfunctions, failures, or difficulties of any kind, whether human or technical; (iii) failed, incomplete, garbled, or delayed computer or e-mail transmissions; (iv) any condition caused by events beyond the control of the Sponsor; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Sweepstakes; or (vi) any printing or typographical errors in any materials associated with the Sweepstakes. The Sponsor reserves the right, in its sole discretion, to suspend, modify or cancel the Sweepstakes should any unauthorized human intervention or other causes beyond the Sponsors’ control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In the event that proper administration of the Sweepstakes is prevented by such causes as contemplated above, the Sponsor will pick the winners from all eligible, non-suspect entries received prior to such action. By participating in the Sweepstakes, participants and winner agree to release, discharge and hold harmless the Released Entities, and all others associated with the development and execution of the Sweepstakes, from any and all losses, damages, rights, claims and actions of any kind arising out of or relating to the Sweepstakes, participation in the Sweepstakes, or travel to/from or attendance at any event relating to Sweepstakes, the prize, and/or acceptance, possession, use or misuse of the prize, including but not limited to statutory and common law claims for misappropriation or participant’s right of publicity. This Sweepstakes shall be governed by Massachusetts law. By participating in this Sweepstakes, entrants agree that Massachusetts courts shall have jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that venue shall be only in Boston, Massachusetts.
 

6. WINNERS LIST: To obtain a copy of the Official Rules or the first name, last initial, city and state of the Sweepstakes winner(s) after the Sweepstakes End Date, send a separate self-addressed, stamped envelope marked Swipe into Savings Holiday Sweepstakes to Promotion Sponsor, Attn: Stephanie Dennehy, Chief Marketing Officer. Requests for winners list must be received no later than 90 days from the Sweepstakes Date (residents of Vermont and Washington need not include return postage).

8. NOTICE: The Sponsor reserves the right to prosecute and seek damages against any individual who attempts to deliberately undermine the proper operation of the Sweepstakes in violation of these Official Rules and/or criminal and/or civil law.
